General Terms and Conditions

These General Terms and Conditions (GTC) are prepared to regulate services in the field of sports, fitness, health, and leisure organization within the framework of training conducted by self-employed individual Daria Sayapina, located at Ovenecká 1022/15, 170 00, Prague 7 – Holešovice, ID: 09740651.

1.CONTRACTUAL AGREEMENT

1.1. Validity of GTC

These General Terms and Conditions (GTC) apply to all contracts including the obligation to pay a contribution concluded between Daria Sayapina and studio members, unless otherwise agreed in individual cases. Members are individuals authorized to use one or more fitness studios (hereinafter referred to as Studios or individually Studio).

1.2. Conclusion of Contract

A member may choose between the offered initial contract periods and one of the payment methods when concluding the contract. The member shall first provide the Studio’s employee with the identification details necessary to conclude the contract. The contract becomes valid from the moment of payment for the future visit to the studio. Alternatively, the contract can also be concluded online on the website booking system https://booking.reservanto.cz/Modal/?id=21028&fbclid=PAAaZLJagd_jbim2UUZIlcqJuL6ppJbSaDaq7fxuIq8Tc-N1aC7hmFnX_FfK8_aem_ATxQv0ooooqGD4tFemULSLsuBgHYPFtZiCMxL5HyqVHuTrdkZvQcTu7orLOuVqAuOqE. In such case, the contract becomes valid once Daria Sayapina confirms its conclusion to the member via email.

2.USE OF THE STUDIO / ADDITIONAL SERVICES

2.1. Scope of Studio Use

By concluding the contract, the member gains access to one or more Studios and is entitled to use them during the respective period.

All classes take place in a specially equipped studio located at: Francouzská 31, 12000, Prague 2. There is no wheelchair access.

2.2.1. Operating Rules

Daria Sayapina is authorized to establish the operating rules of the respective Studio, which are binding for members. The operating rules include provisions regarding the permissible use of equipment/Studios and the protection of the rights of other members. They also apply to contractual partners whose Studios the member is authorized to use according to the membership agreement.

The teaching is offered in individual and group formats, divided into three categories: morning groups on weekdays, courses for in-depth style study, and evening and weekend groups:

    • Morning groups are held only on weekdays, with reservations and payments managed through the reservation system. Drop-in classes are not available; all lessons are part of a subscription plan. Single attendance is allowed only once and at the full price of a lesson. Subscriptions cover all classes under the chosen plan and apply to selected days of the week. With prior agreement with the instructor, it is possible to reschedule a lesson or transfer unused lessons to the following month, provided a subscription for that month is purchased. The maximum group size is six participants, except when making up a missed class by prior arrangement. Refunds are not available after purchasing a subscription.
    • Courses are booked and paid for through the reservation system. To ensure the best experience, completing a trial lesson is required before enrollment. Courses are designed as a cohesive program for in-depth technique development and personal growth. For this reason, courses must be purchased as a whole, and individual lessons cannot be paid for separately. Refunds are not available once a course is purchased.
    • Evening and weekend groups are open for registration through the reservation system. Participants may attend individual lessons or purchase a subscription for a set time period. Refunds for missed individual lessons are credited to the customer’s account in the registration system. Registration is completed separately for each lesson.

2.3. Authority to Give Instructions

The attending staff is authorized to give instructions if it is necessary to maintain the proper operation of the Studio, order, and safety or to comply with the operating rules. These instructions must be followed.

2.4. Class Replacement

In the event of an instructor’s illness or any other unforeseen circumstances, Daria Sayapina shall have the authority to replace any scheduled class with any other class from the Studio’s offerings.

 

3.MEMBER’S OBLIGATIONS

3.1. Email Address Disclosure / Changes to Membership Details

The member is required to provide Daria Sayapina with the current email address when concluding the contract, through which communication with the member can take place. The member expressly agrees that statements important from a legal perspective (e.g., contractual documents, reminders, statements about changes in General Terms and Conditions) may be sent either in writing by post to the postal address last provided, or electronically by email to the email address last provided.

3.2. The member must immediately notify of any changes to relevant contractual details (in particular, names, addresses, email addresses, bank connections, etc.).

3.3. Consumption Prohibition / Prohibited Items

The member may not smoke, consume alcoholic beverages, or intoxicating substances in the Studios.

Furthermore, the member may not bring into the Studio prescription medicines not intended for the personal and medically prescribed use of the member, intoxicating substances, and/or other substances enhancing the member’s physical performance (e.g., anabolic steroids), and alcoholic beverages. The member may not offer, procure, transfer, or otherwise make available the aforementioned substances in the Studios, whether for a fee or free of charge.

  1. PAYMENT AND OBLIGATION TO PAY MEMBERSHIP FEES / PRICE ADJUSTMENT / DELAY IN PAYMENT

4.1. Method of payment. Due date for monthly fees.

Payment Systems: all lessons, including morning, evening, and weekend sessions, as well as courses, can be booked and paid for through our reservation system (by card or bank transfer):

  • Morning Lessons: Reservations and payments are managed through the system. If a client begins the course after the start of the month, the price will be adjusted proportionally to the remaining period until the end of the calendar month.
  • Evening and Weekend Lessons: Payments are determined based on the selected subscription plan and apply to the period specified in the system.
  • Courses: Payments are made through the system and are subject to the terms and conditions specified for the particular course.

4.2. The price of any lesson or subscription is listed on our online reservation system HERE (make the link clickable to the page of the website with information about product prices).

4.3. Right to adjust the price

4.3.1. Daria Sayapina is entitled to increase the monthly membership fee, and will exercise the right to increase the price by a declaration in written form. The price increase shall be effective from the first day of the month following the delivery of the declaration.

4.4. Delay in payment. If a member is late with payment, Daria Sayapina reserves the right to invoice the member for late fees if the delay was caused by the member. In addition to late payment interest at the statutory rate, the member shall also be liable for the costs of legal enforcement appropriate to the purpose, including expenses associated with reminders and collection, court fees, and legal representation costs.

 

  1. DURATION / TERMINATION / WITHDRAWAL / SUSPENSION

5.1. In the case that a member (consumer) concludes a contract online, in accordance with the provisions of Section 1829 (1) of the Civil Code, they have the right to withdraw from the contract within 14 days from the date of conclusion of the contract, without giving any reason.

5.2. For the purpose of exercising the right to withdraw from the contract, the member must inform Daria Sayapina of their decision to withdraw from the contract by means of a clear statement (e.g., by email or letter sent by post). To comply with the withdrawal period, it is sufficient to send a notice of the exercise of the right to withdraw from the contract before the relevant deadline expires.

5.3. Suspension of the contract

5.3.1. Evening and Weekend Lessons:
Cancellations must be made at least 24 hours in advance; otherwise, the lesson will be charged. If you cancel a lesson at least 24 hours in advance, you may replace it with any other open session within the active period of your subscription. If you plan to be away for more than two weeks, we recommend not purchasing a new subscription; instead, buy a single lesson and purchase a new subscription upon your return.

5.3.2. Morning Groups (Weekdays):
The 24-hour rule does not apply in this case. If you miss a lesson, you may replace it with any other morning session within the same month or postpone it to the following month (provided you purchase a subscription for the following month). If you know you will be unavailable for a short period (e.g., one week), you can attend on another day within the same month (e.g., take two lessons in one week). If you plan to be away for a longer period, we recommend consulting your trainer.

5.3.3. Courses:
Cancellations for individual course lessons must be made at least 24 hours in advance; otherwise, the lesson will be charged. Replacement sessions are possible during open lessons within the active course period or after the course ends.

5.3.4. The subscription can be frozen for the duration of illness with a confirmation from a doctor. In the case of illness that prevents further attendance – a refund of 50% of the costs of lessons that will not be attended.

5.3.5. Subscriptions for morning groups are valid for one calendar month, with the price determined by the number of weekdays in that month. Evening and weekend groups have a fixed price based on the chosen duration – you can select a subscription for either 7 or 18 weeks. Courses are designed as a series of 10 lessons with a fixed price that includes all scheduled sessions.

5.3.6. In the case of cancellation of a lesson due to the School’s fault, the client is given the option to attend another lesson, or at their request, the costs for canceled lessons are refunded or may be credited towards the payment of the next subscription.

5.4. Right to extraordinary termination

The right of both contractual parties to terminate the contract immediately for serious reasons is not affected by the aforementioned provisions.

5.5. Submission of termination by the member or notification of suspension of the contract by the member

Each termination or planned suspension must be sent by the member with the member’s number by post to Daria Sayapina’s address or by email to the official email address info@bodylab.space.

 

  1. LIABILITY

6.1. The fitness studio shall not be liable to members for any property or non-property damage, or this liability is limited to the fullest extent permitted by Czech law. The fitness studio, in particular, shall not be liable for damage incurred by members as a result of their failure to fulfill their obligations stipulated by generally binding legal regulations, the membership agreement, these terms and conditions, the operational regulations of the fitness studio, or the instructions of its staff. Each member is fully responsible for their health condition; any liability of the fitness studio for the member’s health condition is excluded. The fitness studio further particularly disclaims liability for valuables stored in a location other than designated for that purpose.

6.2. By paying for any lesson or subscription, and thus confirming agreement to the contract terms, each participant confirms their consent to the taking of photographs and videos during lessons, and the publication of these materials solely for the advertising purposes of the organizer on its social media platforms, as well as in any advertising publications, both online and in print.

 

  1. CONSUMER ARBITRATION

The member has the right to out-of-court resolution of consumer disputes. The subject of out-of-court resolution of consumer disputes is the Czech Trade Inspection (www.coi.cz).

 

  1. FINAL PROVISIONS

8.1. Changes to these Terms and Conditions

Daria Sayapina, except for obligations arising from the main performance, is entitled to change these General Terms and Conditions with future effect. Obligations arising from the main performance are those obligations that will only enable the proper performance of the contract, and compliance with which the parties may legitimately expect. Daria Sayapina shall inform the member of the changes and provide them with the opportunity to object to the changes within a reasonable period of at least 30 days after becoming aware of them, and shall specifically draw attention to the fact that if no objection is made, the changes will become effective.

8.2. Ineffectiveness of Individual Provisions

If any one or more provisions of this agreement are or become ineffective, this shall not affect the validity of the agreement and its remaining provisions.

8.3. Applicable Law

The contractual relationships arising from these Terms and Conditions shall be governed by the laws of the Czech Republic, in particular the Civil Code.
